Welcome

These Terms of Use ("Terms") govern your use of provenanceoversight.com (the "Site"), operated by Provenance Oversight LLC ("Provenance," "we," "us," or "our"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

These Terms govern the Site only. They are separate from, and don't replace, any service agreement between you and Provenance if you become a client — that agreement, not this page, governs the actual work Provenance does for you.

About This Site

The Site describes Provenance's services — Property & Estate Oversight, Family Liaison & Home Support, and Household Transition & Estate Support — and provides general information about how Provenance works. Content on the Site, including any future articles, guides, or checklists we publish, is informational and general in nature. It's not a substitute for an actual conversation about your specific situation, and using the Site doesn't create a client relationship, service obligation, fiduciary relationship, or agency relationship between you and Provenance, and doesn't guarantee that Provenance will accept any particular engagement.

Submitting an Inquiry Isn't an Engagement

Submitting the Contact / Request Support form, emailing us, calling us, or texting us starts a conversation — it doesn't create a client relationship. A Provenance engagement begins only when you and Provenance enter into an applicable written service agreement. Until that happens, nothing on the Site or in our communications with you should be understood as Provenance having agreed to perform any service.

Availability

"One call. Trusted follow-through." describes having a single trusted point of contact — not guaranteed, immediate, or around-the-clock availability. Nothing on the Site promises 24/7 availability, emergency response, immediate response, continuous monitoring, or a guaranteed response time. Response times depend on the nature of the request and the scope of any actual engagement.

Not an Emergency Service

Provenance is not an emergency service and should not be relied on for one. If you have a medical, safety, fire, security, or other emergency, please contact 911 or the appropriate emergency service directly rather than Provenance.

The Nature of Our Services

Family Liaison & Home Support is practical, household-focused support — the kind of everyday help a nearby family member might provide. Provenance is not a medical provider, home-health provider, caregiver, or emergency-response service, and nothing on the Site should be read to suggest otherwise.

Independent Contractors and Third-Party Professionals

Provenance may help identify, coordinate, schedule, provide access to, communicate with, or oversee independent contractors, vendors, licensed professionals, movers, appraisers, auction houses, consignment providers, storage providers, and other specialists on a client's behalf. These providers are separate businesses responsible for the services they perform, particularly licensed, specialized, or regulated work. Provenance coordinates and stays connected to the process within the scope of an engagement; it doesn't take over the qualified provider's responsibility for their own work.

No Professional Advice

Nothing on the Site — including any current or future articles, guides, checklists, or other Resources content — is legal, financial, medical, insurance, appraisal, engineering, construction, or other licensed or professional advice. It's general information only. For advice specific to your situation, consult an appropriately qualified professional.

Household Contents and Transitions

Where the Site describes services involving sorting, documenting, consignment, donation, storage, moving, or similar household-transition work, that description doesn't give Provenance authority to make decisions about ownership or disposition of any property or belongings. Those decisions remain with the client or their authorized representative, and how they're handled in an actual engagement is addressed in the applicable service agreement.

Property Oversight

Property & Estate Oversight is provided within the scope of an actual engagement and doesn't warrant or guarantee that every condition, defect, leak, failure, security issue, storm-related condition, or other property problem will be discovered or prevented. Provenance is not an insurer, security service, or property inspector, and using the Site or engaging Provenance doesn't guarantee against loss, damage, or an undiscovered condition.

Site Content, Accuracy, and Availability

We try to keep the Site accurate and current, but we don't promise that it's error-free, complete, or up to date at every moment, and we may change, update, or remove content at any time without notice. We don't guarantee the Site will be available without interruption. The Site may link to third-party websites we don't control; a link doesn't mean we endorse that site, and we're not responsible for its content or practices.

Intellectual Property

The Provenance name, logo, and branding, the original text and copy on the Site, photographs owned by Provenance, and any articles, guides, checklists, or other original content we publish are owned by Provenance or used with permission, and are protected by applicable intellectual property laws. You may view and share Site content for personal, non-commercial reference, but you may not copy, reproduce, republish, or use it for commercial purposes without our permission. We don't claim ownership of any third-party trademarks, images, or materials that may appear on the Site, and nothing here should be read as claiming rights we don't actually hold.

If you believe content on the Site infringes your intellectual property rights, contact us at inquire@provenanceoversight.com with enough detail for us to look into it.

Privacy

Our Privacy Policy explains how we collect, use, and protect information submitted through the Site, including through the Contact / Request Support form. It's part of how the Site operates, and by using the Site you acknowledge it.

Communications

If you submit the Contact form or otherwise reach out with your phone number or email, you're agreeing to receive communications from Provenance related to your specific inquiry — by email, phone, or text, depending on what you provide and select. This doesn't enroll you in marketing communications; see the Privacy Policy for more detail on how we use and don't use your information.

Disclaimer of Warranties

The Site and its content are provided "as is," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.

Limitation of Liability

To the extent permitted by law, Provenance won't be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the Site, even if we've been advised of the possibility of those damages. This limitation applies to use of the Site itself; it doesn't apply to or limit any liability terms in an actual client service agreement, which are addressed separately in that agreement.

Indemnification

You agree to indemnify and hold Provenance harmless from claims, damages, or expenses (including reasonable attorneys' fees) arising from your unlawful misuse of the Site, your violation of these Terms, or your infringement or other wrongful conduct in connection with the Site.

Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site will be subject to the jurisdiction of the state and federal courts located in Palm Beach County, Florida.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll update the effective date above. Updated Terms will apply to use of the Site from their effective date.

Severability

If any provision of these Terms is found unenforceable, the rest of these Terms remain in full effect.

Relationship to Client Service Agreements

These Terms govern use of the Site only. Pricing, payment, scope of services, authorization, property access, vendor coordination, materials, consignment proceeds, cancellation, and liability relating to an actual engagement are addressed in the applicable client service agreement, not in these Terms.
